According to the Law of Ukraine "On protection of industrial designs",

the object of industrial design can be:

- form ,

- drawing,

- coloring ,

- a combination thereof.

These criteria define the appearance of industrial products and are intended to meet the aesthetic and ergonomic needs.

According to the Law , the following objects can not obtain legal protection :

- architectural objects (except for small architectural forms)

- industrial , hydraulic and other fixed structures ,

- printed matter ,

- objects of unstable form of liquid, gas-like, loose, and similar substances.

Industrial design must correspond with the criterion of patentability, namely the criterion of novelty.

The industrial design application may be filed at the label, advertising brochure, drawing on the wallpaper, fabric, appearance, equipment, apparatus, tools, furniture, or clothing. The application may be applied for a single product and the kit or set of items.

Validity of a design patent is 10 years from the filing date of the application form, and can be extended, but not more than for 5 years. The patent owner has the right to use their industrial design, as well as to authorize or prohibit the use of such to other people.

The Patent Office provides an examination of the application for an industrial design. "The decision to grant a patent" is issued after successful completion of the examination to the applicant, according to which it is necessary to pay official fees for the issuance of the patent.
