Intellectual property valuation

Types of intellectual property to be evaluated: 

- Industrial property - patents, utility model patents, design patents, trademarks; 

- objects of copyright and related rights - the works of science, literature, art, computer programs and databases; 

- information of trade secrets (know-how). 

According to the Law of Ukraine "On the assessment of property, property rights and professional valuation activities in Ukraine," valuation of the property is held in the cases established by the legislation of Ukraine and international agreements on the basis of the contract, as well as at the request of one of the parties to the agreement and consent of the parties. 

Under the law, intellectual property valuation may be required: 

- when making intellectual property as a contribution to the charter capital; 

- in the formulation of intellectual property on the balance of the inventory; 

- the transfer of rights to intellectual property; 

- to determine the cost of licenses for the use of intellectual property; 

- to determine the size of royalties; 

- in negotiations with potential investors and creditors; 

- in case of sale of a business; 

- if necessary, to determine the damage caused by violation of the exclusive rights to intellectual property.
