Protection of intellectual property

The Civil Code of Ukraine provides the following ways to protect intellectual property rights in Ukraine:

- the use of immediate measures to prevent the violation of intellectual property rights and the preservation of relevant evidence;
- suspension of crossing the customs border of Ukraine of goods, which import or export is carried out in violation of intellectual property rights;
- exemption from civil circulation of goods manufactured or put into circulation in violation of intellectual property rights;
- exemption from civil circulation of materials and tools used mainly for the manufacturing of goods in violation of intellectual property rights;
- use of a single monetary penalty in lieu of damages for the misuse of intellectual property rights. Size is determined by the recovery according to the law with taking into account the guilt of the person or other circumstances that are essential;
- publication in the media of information about violations of intellectual property rights and the content of the judgment of the breach.
